GENERAL TERMS OF SERVICE

Welcome to our application plattform (hereinafter "the Service"). These terms of service govern your access to and use of the Service. By creating an account and using the Service, you agree to be bound by these terms.

1. About the Service and its purpose

The Service is provided by Stiftelseansökan ("we", "us") and is a platform for the digital management of applications and related data.

• Recipient: We are the sole and final recipient of the applications and data submitted via the Service for the purpose of reviewing, evaluating, and making decisions regarding them.
• Cooperation: In the event of an approved application, the Service acts as a platform for continued cooperation between you and us in relation to the specific purpose of the application.

2. Registration and user account

You are responsible for ensuring that the information you provide during registration is accurate. Your account is personal, and you are responsible for keeping your login credentials confidential. All activity occurring through your account is considered your own.

3. Use of the Service

As a user, you agree not to use the Service for illegal purposes, not to upload malicious code, and to ensure that the information in your applications does not infringe on the rights of any third party.

4. Information, intellectual property, and discretion

You retain full ownership and all intellectual property rights to the information and data you upload to the Service. To enable us to administer and make decisions regarding your application, the information may be shared with our staff and consultants engaged by us. All data is handled with the highest degree of discretion and integrity. Your data is never shared with third parties for commercial or marketing purposes. You grant us a necessary right to store and process your data solely to operate the Service and facilitate the application process.

5. Availability and liability

The Service is provided on an "as is" basis. We strive for high availability but do not guarantee uninterrupted operation. We bear no liability for direct or indirect losses that may arise as a result of decisions regarding your application or due to technical errors in the Service.

6. Suspension and account removal

As a general rule, you may terminate your use of the Service and request that your account be removed at any time. Exception for active cases: If your account is linked to one or more active applications covered by extended agreements or specific contracts between you and us, the account cannot be removed until these obligations are formally completed or the agreement has expired. We reserve the right to suspend accounts that violate these terms.

7. Changes to the terms

We reserve the right to update these terms. In the event of significant changes, you will be notified via the email address linked to your account. Continued use of the Service constitutes acceptance of the updated terms.

8. Governing law

These terms are governed by Swedish law. Any disputes shall primarily be resolved through discussion between the parties and secondarily by a Swedish general court.

How the fund/association processes your personal data

Information according to the General Data Protection Regulation ((EU) 2016/679)

The personal data controller is the fund/association.

Personal data that you supply when submitting this application, or any other personal data that is registered as part of the application process, is processed by the personal data controller for the purpose of assessing your entitlement to a grant, and for other administrative purposes regarding the grant. Your personal data may also be processed in order for the fund/association to fulfil its obligations in accordance with the law, other regulations or decisions by a statutory authority. This may include the processing of data in order to fulfil obligations under the Swedish Accounting Act or the Swedish Money Laundering Act, or for submitting reports to the Swedish Tax Agency, the Swedish Police, the Swedish Enforcement Authority, the Financial Supervisory Authority and other authorities.

To ensure proper file maintenance, personal data may be supplemented with data obtained from private and public registers, such as address updates via the Swedish Population Address Register Board (SPAR).

Personal data will be supplied for the purposes specified to Skandinaviska Enskilda Banken AB (publ), 502032-9081 ("SEB"), and the application process will be administered by SEB on behalf of the fund/association.

The personal data will be stored as long as needed to fulfil the specified purposes, and to enable the fund/association to meet its legal obligations. If a grant is awarded, the personal data will be stored until the final payment has been issued, and until the projects are officiially published. If a grant is not awarded, the personal data will be stored for eight years.

You have a right to know which of your personal data are processed by the fund. This means you are entitled to:

a) request a copy of the personal data held about you,

b) request correction of incorrect or incomplete information

c) request erasure or restriction of the processing of personal data.

d) object to processing of your data,

e) under certain circumstances, you have a right to retrieve the personal data that you have provided to the fund and to have these data transferred directly to a different personal data controller, if this is technically feasible (data portability).

Your request and/or objection as per above will be assessed by the fund on a case-specific basis. If you wish to order a copy of the personal data held about you or submit a request and/or an objection, please send a written and signed request to SEB Private Banking, Stiftelser, 106 40 Stockholm. Specify which fund the request regards.

Consent to processing of specific categories of personal data

If the personal data you provide in your application include certain specific categories of personal data*, by signing the application form you consent to the personal data provided in your application being processed for the purposes specified above.

You have a right, at any time, to withdraw your consent to the processing of these personal data categories. If you withdraw consent, please note that the fund shall no longer be legally entitled to process these personal data, meaning that the data can no longer be used as a basis for your application.

* "Specific categories of personal data" refers to data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data regarding health, or data regarding a natural person's sex life or sexual orientation."
